1. SCOPE AND APPLICABILITY

These Terms of Sale (“Terms of Sale”) govern all purchases of products made through the website formulajackets.com (the “Site”), operated by FORMULA JACKETS LLC (“we”, “us”, “our”). By placing an order for products on the Site, you (“Customer”, “you”) agree to be bound by and accept these Terms of Sale in their entirety.

These Terms of Sale constitute a legally binding agreement between you and FORMULA JACKETS LLC. Please review these terms carefully prior to completing any purchase.

3. ORDER PLACEMENT AND ACCEPTANCE

Order Submission: Placing an order on the Site constitutes an offer by you to purchase the selected products under these Terms of Sale.
Order Confirmation: Upon receiving your order, we will send an automated order confirmation email detailing the products purchased, pricing, and shipping information. This confirmation email acknowledges receipt of your order but does not constitute official acceptance.
Order Acceptance and Rejection: FORMULA JACKETS LLC reserves the right, at its sole discretion, to accept, decline, or limit any order for any reason prior to shipment, including but not limited to product availability, errors in pricing or product descriptions, or suspected fraudulent activity.

4. PRICING, CURRENCY, AND TAXES

Prices: All prices listed on the Site are in United States Dollars (USD) unless explicitly stated otherwise. Prices are subject to change at any time without prior notice.
Taxes and Customs Duties: Stated prices do not include sales taxes, value-added taxes (VAT), or international import duties unless specified at checkout. You are solely responsible for paying all applicable local taxes, import duties, and customs fees levied by the destination country.
Pricing Errors: In the event that a product is listed at an incorrect price due to a typographical or system error, FORMULA JACKETS LLC reserves the right to cancel any orders placed for the item at the incorrect price.

5. PAYMENT TERMS

Payment Authorization: By submitting payment information, you represent and warrant that you are authorized to use the designated payment method and authorize FORMULA JACKETS LLC to charge the total order amount (including product costs, applicable shipping fees, and taxes).

6. SHIPPING AND RISK OF LOSS

Fulfillment and Delivery: Shipping dates and delivery timeframes provided on the Site are estimates only and are not guaranteed. FORMULA JACKETS LLC shall not be liable for delivery delays caused by shipping carriers, weather, or customs clearance processes.
Passage of Risk: Risk of loss and title for all items purchased pass to you upon our delivery of the items to the shipping carrier.

7. 30-DAY MONEY-BACK GUARANTEE AND RETURNS

30-Day Return Window: We offer a 30-day money-back guarantee. You have 30 calendar days from the confirmed date of delivery to request a return for a full refund of the product purchase price.
Condition of Returned Items: To qualify for a full refund, all returned items must be unworn, unwashed, unaltered, and in their original packaging with all original brand tags and labels attached.
Return Authorization: All returns must be initiated by contacting support@formulajackets.com to receive a Return Merchandise Authorization (RMA) and specific shipping instructions. Returns sent without prior authorization will not be processed.
Return Shipping Fees: Unless the return is due to a manufacturing defect or an error on our part, return shipping costs are the responsibility of the customer.

8. LIMITED WARRANTY AND DEFECTIVE PRODUCTS

FORMULA JACKETS LLC warrants that products delivered will materially conform to the descriptions provided on the Site and be free from material manufacturing defects upon arrival. If you receive a damaged or defective item, you must notify us at support@formulajackets.com within 48 hours of delivery with clear photographs of the damage. Upon verification, we will provide a prepaid return label and issue a replacement or full refund.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FORMULA JACKETS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE PURCHASE, SALE, OR USE OF ANY PRODUCTS. FORMULA JACKETS LLC’S TOTAL AGGREGATE LIABILITY ARISING FROM ANY PURCHASE SHALL NOT EXCEED THE ACTUAL PURCHASE PRICE PAID BY YOU FOR THE PRODUCT GIVING RISE TO THE CLAIM.

10. GOVERNING LAW AND JURISDICTION

These Terms of Sale, and any disputes or claims arising out of or related to your purchase, shall be governed by, construed, and enforced in accordance with the laws of the State of New York, United States, without giving effect to any principles of conflicts of law. Any legal action arising from these Terms of Sale shall be brought exclusively in the federal or state courts located in New York, NY.

11. AMENDMENTS

FORMULA JACKETS LLC reserves the right to modify these Terms of Sale at any time. Any changes will be effective immediately upon posting to the Site. Your continued purchase of products following the posting of revised Terms of Sale constitutes your acceptance of the changes.
